3. Definitions

  • User: Refers to anyone accessing or using the Site.
  • Wholesaler: Refers to individuals or entities that acquire and assign contracts for properties.
  • Property: Any real estate listed or marketed on the Site.

4. User Responsibilities

Users are responsible for their interactions with others on the Site. Users agree to:

  • Comply with all applicable laws and regulations.
  • Provide accurate and truthful information in all property listings.
  • Ensure they have the legal right to market and assign any property listed on the Site.
  • Acknowledge that Off Market Flip LLC does not participate in transactions or provide real estate brokerage services.

5. Property Condition Disclosures

It is the sole responsibility of the property owner or wholesaler to provide accurate property condition disclosures in accordance with local laws. Off Market Flip LLC is not responsible for the accuracy of these disclosures.

6. Agency Disclosure

Wholesalers and agents using the Site must comply with all legal obligations, including agency disclosures to property owners and buyers, as required by state and federal law. Off Market Flip LLC does not act as a real estate agent or broker.

7. Limitation of Liability

Off Market Flip LLC, its owners, and its affiliates shall not be liable for:

  • Any indirect, incidental, or consequential damages resulting from the use of the Site.

  • Any disputes or claims between users, including wholesalers, buyers, or agents.

9. Governing Law

All wholesalers using the platform are responsible for obtaining and ensuring compliance with any state or federal requirements related to marketing an equitable interest in properties, such as Nebraska’s LB892 or any other state-specific regulations. Off Market Flip LLC is a private marketing platform and does not engage in brokerage activities, real estate transactions, or assume responsibility for legal compliance in wholesaling transactions.
